Terms and Conditions for Lowkey Discord Digital Subscription (ABN 72 641 939 755)

Effective Date: 7 October 2025. Changes to these terms may happen at any time at discretion of Lowkey Discord.

1. Acceptance of Terms

By accessing and using Lowkey Discord, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please refrain from purchasing or using the Service.

2. Definitions

1. In this document:
   1. “Lowkey”, “Lowkey Discord”, “we” or “us” means Lowkey Discord (J C HOLDINGS CONSULTING PTY LTD).
   2. “Member”, “Subscriber”, or “You” means a person who is a consumer of Lowkey Discord’s Digital Subscription Service.
2. These Terms and Conditions may use terminology popular in the internet space related to reselling which are equivalent to Lowkey Discord. This section will attempt to provide an articulable definition to terms that may be used in this document.
   1. “Lowkey” – Lowkey is the name of the registered Proprietary Limited and the primary Discord server. 
   2. “Cook Group” – cook groups are online communities of people who buy and resell limited edition or high-demand items to make profit. 
   3. “Leak/Leaker” – Leaking occurs when a member of Lowkey provides content from the server (behind the paywall) to any other individual, server or program outside of Lowkey. The content posted throughout the server is intended for members only.
   4. “Whop” – Third-party commerce platform we use to manage checkout, subscription billing, customer accounts and receipts.

3. Digital Subscriptions

1. A digital subscription grants you unlimited access to Lowkey Discord, including its valuable content and resources. 
2. To activate your digital subscription, you must associate it with your name, email address and Discord account. Please keep your login credentials, including your email/username and password, confidential and refrain from sharing them with others.
3. Please be aware that any misuse of your login details and account, such as simultaneous access from multiple devices or unauthorised user sharing, will likely trigger the deactivation of your subscription, without notice and no eligibility for a refund. 

By becoming a member of Lowkey Discord, you agree to adhere to the rules and guidelines specified within our server when joining. It is important to note that Lowkey reserves the right to revoke your membership if any violation of these rules is suspected, without the possibility of a refund. 

4. Subscription and Payment

1. Access to Lowkey Discord requires a paid subscription, your subscription to the server will activate soon after.
2. Members are granted a fully revocable, non-transferable, membership to gain access to Lowkey Discord.
3. Payment will be processed through Whop and its payment sub-processors (e.g. Stripe/PayPal), and you agree to provide accurate and complete payment information. Your payment details will be verified before your subscription is activated.
4. Subscription fees will be billed automatically on a recurring basis according to the selected plan, to which you agree to pay all fees, charges and taxes (if applicable). 
5. Once granted access to Lowkey Discord, all subscription fees are considered final and non-refundable.
6. It is your responsibility to provide a valid payment method and that payment details are kept safely and up to date, this can be managed through [site]. This responsibility extends to the expiration of a debit/credit card or invalid payment method, which may result in the termination of your subscription and membership.

In the event of you violating the Terms & Conditions, Lowkey Discord reserves the right to immediately and irrevocably terminate your subscription and your membership will no longer be considered valid.

6. Service Description

1. The Service provides access to a digital subscription Discord group where a subscribed member can learn how to buy and resell limited edition or high-demand items, including but not limited to sneakers, collectibles, with the intention to make profit. 
2. Lowkey Discord reserves the right to modify, update, or discontinue the Service at our discretion. We will make reasonable efforts to provide 30 days notice prior to any new modifications taking effect.
3. By continuing to access or use the Service during or after revisions to our terms become effective, you agree to be bound by the revised terms. If you at any point do not agree to the revised terms, in whole or in part, please discontinue using the Service in its entirety.
4. Any content you upload or share on the Service must comply with our content guidelines. Additionally, we reserve the right to remove or restrict access to the content you see that violates our guidelines. These guidelines can be found on the Discord server.
   

7. Pricing and Transaction Currency

1. By subscribing to our Service, you agree to pay the applicable subscription fees as outlined at the time of purchase. We reserve the right to modify subscription fees at any time. These fees are subject to change, and any modifications to the pricing will be communicated in advance.
2. Subscription fees will be billed automatically based on the selected billing cycle (monthly, annually, etc.) You authorise us to charge the provided payment method for recurring subscription fees.
3. Failure to pay subscription fees may result in the suspension or termination of your access to Lowkey Discord.

As a primarily focused Australian based digital subscription entity, pricing and transactions on our platform are processed in Australian dollars (AUD). The final amount may be subject to exchange rate fluctuations or fees by your financial institution. 

8. Promotions and Discounts

From time to time, we may offer promotions or discounts on subscription fees. The terms and conditions of any such promotions will be communicated at the time of the offer.

9. Refunds and Cancellations

1. In the event you wish to cancel your subscription to our Service, you can do so by Whop. Alternatively, please contact our support team via Discord who will be able to assist in a timely manner. 
2. All membership fees are considered final and non-refundable. Lowkey Discord is committed to customer satisfaction, if you are experiencing issues with billing or otherwise unhappy our support team via Discord will be able to assist further.
3. Digital subscriptions are non-refundable except in instances of proven hardship or as required by the Australian Consumer Law, including any customer guarantees established by it.

If you choose to cancel your membership before the end of the current term, you will retain access to the server for the remaining duration of that term. This access ceases at the end of the term, and renewal is required for continued membership to our subscription service. 

10. Security Capabilities for Transmission of Payment

1. We take the security of your payment card details seriously. Our payment processing is carried out through third-party payment platforms PayPal, Whop and Stripe who are in compliance with industry-standard security measures. 
2. If you choose to make payments through a third-party payment platform (e.g., Stripe, PayPal, Whop), you are subject to the terms and conditions of that platform. We are not responsible for any fees, restrictions, or issues arising from your use of third-party payment services.

11. Disclaimers

1. Lowkey Discord makes no representations or warranties of any kind, express or implied, as to the operation of the services, or the information, materials, content, or products included in the Service. You expressly agree that your use of the Server and your subscription is at your sole risk.  
2. The information, content, and materials included in your subscription are provided for general informational purposes only and do not constitute professional or financial advice. Lowkey Discord does not guarantee the accuracy, completeness, or usefulness of any information or materials on the services and holds no liability for any loss or damage you may incur in connection with your subscription, to the fullest extent permitted by applicable Australian law.

12. Digital Subscription Obligations

1. You are responsible for providing accurate and current information during the subscription sign-up process. Keep your account information, including email address and payment details, up to date in accordance with our Subscription Terms & Conditions – please see clause 2.
2. You are responsible to safeguard your login credentials, including email/username and password. Do not share this information with others, and take reasonable measures to prevent unauthorised access to your account.
3. You agree to adhere to the rules and guidelines outlined in the document. Failure to comply may result in the termination of your subscription without eligibility for a refund.
4. You agree to ensure prompt payment of subscription fees according to the selected billing cycle and familiarise yourself with our pricing terms, including any additional fees.
5. You are responsible to utilise the digital subscription service for its intended purpose. Any unauthorised use, including but not limited to modifying, distributing content, member abuse, or leaking, is strictly prohibited.
6. You agree that your use of the Service, along with all subscriptions, benefits, or promotions provided by Lowkey Discord, shall be in compliance with all applicable laws and regulations, and irrespective of your location, such subscriptions, benefits and promotions shall be deemed to be provided in Australia. The terms of these subscriptions, benefits, and promotions shall be governed by New South Wales law and its legislation, and any matters involving or alleged to involve Lowkey Discord shall fall under the exclusive jurisdiction of the Courts of New South Wales. You are solely responsible for ensuring that your use of the Service is lawful in your jurisdiction. 

13. Customer Data Privacy Policy

1. Lowkey Discord may collect personal information from you during the subscription process and through your use of the digital service. This information may include, but is not limited to, your name, contact details, and payment information. The personal information collected is used for the purpose of managing and maintaining your subscription, providing customer support, and improving the overall user experience of Lowkey Discord.
2. Reasonable measures are taken to secure the personal information we collect and store. This includes encryption, access controls, and regular security assessments to protect against unauthorized access, disclosure, alteration, or destruction of your personal data.
3. We may engage third-party service providers to process certain aspects of your personal information. These third parties are bound by confidentiality agreements and are required to implement appropriate security measures.
4. We comply with all relevant privacy laws and regulations in Australia, including the Privacy Act 1988 (Cth). If you have concerns about our data handling practices, you may contact the Office of the Australian Information Commissioner (OAIC).
5. Lowkey Discord reserves the right to update this Customer Data Privacy Policy periodically. Any changes will be communicated to you, and your continued use of the digital service after the effective date constitutes acceptance of the updated policy.
6. By using Service, you acknowledge and agree to the terms outlined in this Customer Data Privacy Policy. If you do not agree with any of these terms, please refrain from using our service.
